STANDARD CONDITIONS FOR MEDICAL LABORATORY SERVICES
These Terms and Conditions shall apply to all medical laboratory services provided by PathCare Nigeria Limited (PathCare). The Client hereby agrees that all services are carried out subject to the following terms and conditions:-
1. The Client shall submit samples to PathCare accompanied by a PathCare requisition form. The Client must ensure that the content of any submitted requisition form is complete and accurate.
2. PathCare shall not be liable for any defective report due to inaccurate completion of the requisition form.
3. The Client shall submit samples to PathCare in appropriate containers, correctly labeled and sealed. A fresh sample may be required in the event that the sample sent is inappropriate, inadequate, contaminated or heamolysed.
4. PathCare shall perform the requisite analysis on the samples at PathCare laboratories within and outside Nigeria.
5. The Client agrees to pay all costs resulting from any act or omission of the Client including suspension of work, modification of requirements, failure to supply information required to proceed with requested work.
6. The Client agrees to pay for all Laboratory testing requested by the Client, even if a failed result is reported by PathCare Nigeria due to the sample being inadequate or of poor quality.
7. The Client shall not withhold payment for any reason whatsoever unless agreed to by PathCare Nigeria in writing.
8. All information is confidential and will be treated as such.
9. E-mail of the Test Results may be sent at the request of the Client. However, PathCare takes no responsibility whatsoever for any errors in transmission or technical failures in the system which may inter alia result in breach of confidentiality and/or delay or failure in delivery.
10. PathCare shall not be liable for special, indirect, punitive, or consequential damages or losses including, without limitation any loss, charges or expenses caused directly or indirectly by any delay in carrying out the services.
11. All third party liabilities shall be the sole responsibility of the Client.
12. PathCare accepts no responsibility for any losses which may occur as a result of human or technical error. Should gross negligence be proven, the damages shall not exceed the value of the contract.
13. PathCare shall not be responsible in any way whatsoever, in the event that the requisitioned tests cannot be performed or any obligations whatsoever to the client cannot be fulfilled for any reason beyond the reasonable control of PathCare including without limitation any strike, lockout or other form of industrial action, Government action, floods, fire or Acts of God.
14. Fees are subject to change at the discretion of PathCare.
